The law firm Vejmelka & Wünsch has successfully represented Zásilkovna in the Competition Office’s anti-trust proceedings

Vejmelka & Wünsch has successfully represented Zásilkovna, a leading company on the Czech market for out-of-home delivery operations, in the proceedings before the Czech Office for the Protection of Competition. The Office conducted an investigation into non-compete clauses concluded between Zásilkovna and operators of pick-up and drop-off points that prevented these operators from co-operating with competing businesses. According to the Office’s preliminary assessment, the non-compete obligations could result in anti-competitive foreclosure of the market in breach of the applicable competition rules. The Office has now adopted a decision by which it accepted the commitments proposed by Zásilkovna and stopped the proceedings lasting more than three years. Thanks to convincing legal argumentation and active communication with the Office, it was possible to substantially remove the Office’s concerns about maintaining effective competition on the market. The proceedings have been closed with the adoption of commitments which preserve the non-compete clause in contracts with delivery points and introduce a mechanism enabling co-operation with another supplier, thereby guaranteeing effective competition for the future. At the same time, the successful completion of the proceedings will allow Zásilkovna continuing in operation and development of a high-quality and reliable network of delivery points for its customers.
